Important Note: Life Quest Counselling is the trade name for app and web-based services provided by Life Quest Edutech Pvt Ltd.

These Terms & Conditions govern your purchase of any service or product from Life Quest Counselling from the website or mobile application, www.lifequest.in (referred to in these terms as the “Life Quest Counselling Website/app”) and should be read in conjunction with our General Terms found here.

 

Please read both these Terms and the General Terms carefully before you purchase any service or product from the Life Quest Counselling Website/app App. By purchasing any service or product from Life Quest Counselling, you confirm that you accept the General Terms and these Additional Terms and that you agree to comply with them. Capitalised terms used but not otherwise defined in these Additional Terms have the meaning given to them in the General Terms.

 

Without prejudice to our powers under the General Terms, you agree that we may at our sole discretion, without notice to you, terminate or amend the General Terms or these Additional Terms at any time. 

 

References to "you" and "you're" are references to the individual purchasing any service or product from the Life Quest Counselling Website/app.

 

These General Terms and Conditions (the "General Terms") govern (a)your use of the website/app/any other services in connection to the application/website /products (services) or (b)any modes of registration or usage of products including through mobiles, laptops, tablets or any other storage/transmitting devices between Life Quest Edutech Pvt. Ltd. and its users(User/You/your). 

 

These terms constitute Electronic records in accordance with the provisions of the Information Technology Act and Information Technology (Intermediaries Guidelines) Rules, 2011 thereunder as amended from time to time. These General Terms incorporate our Privacy Policy which describes (among other things) how we will use any personal information collected as a result of your use of the Services. Additional terms, which should be read in conjunction with these General Terms apply to some of our Services ("Additional Terms") and can be accessed.

 

Please read these General Terms (including the Privacy Policy) as well as any Additional Terms carefully, before using any part of our Website/apps, App/ Services. By using the Website/apps, you confirm that you accept the General Terms, the Privacy Policy and any relevant Additional Terms and that you agree to comply with them. Changes to Terms

The General Terms and any Additional Terms may be updated by us from time to time. We will post any changes that we make on this page and will indicate at the top of the page (or on the first page of any Additional Terms) the date that the relevant terms were last revised. Your continued use of our website/app and/or Services after any such changes have been made constitutes your acceptance of the new General Terms and/or Additional Terms. If you do not agree to these changes, please do not use or access (or continue to use or access) our website/app and/or Services.

Registration by you and your online Life Quest Counselling account

 

The Services require you to register and provide information about yourself. You agree to: (a) provide accurate and complete information about yourself as prompted by the relevant registration form and (b) maintain and promptly update this information (by using the appropriate forms on our website/app or emailing us at support@lifequest.in). We may terminate your account and any or all rights that you have been granted to make use of our website/app/ if any information you provide is inaccurate, false, or incomplete 

 

The registration processes on our website/app involve you generating an OTP password by using your mobile number. You are responsible for maintaining the confidentiality of your username, Mobile no and password and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify us of any unauthorised use of your account and any other breach of security, and (b) ensure that you exit from your account at the end of each session. We will not be liable for any loss or damage arising from your failure to comply with these obligations. 

 

You agree that we have no responsibility or liability for the deletion or failure to store any messages, other communications or other content maintained or transmitted by our Services. We reserve the right to deactivate accounts that are inactive for an extended period of time.

Email Communication

​

By registering to Life Quest Counselling you agree to receive occasional “account maintenance” email notifications/mailers/alerts or messages, these will inform you about your account details and also provide links to "Getting Started" resources when you first register as well as essential account information in relation to the Service. You will also be placed on the mailing list to receive our added-value marketing emails that provide additional resources and news about educational apps which you can unsubscribe from at any stage.

Member Content

​

Other members of Life Quest Counselling will also share content via the App. Member Content belongs to the user who posted the content and is stored on our servers and displayed via the App at the direction of the user providing the Member Content.

You do not have any rights in relation to other users’ Member Content, and you may only use other Life Quest Counselling users’ personal information to the extent that your use of it matches Life Quest Counselling’s purpose of allowing people to meet one another. You may not use other users’ information for commercial purposes, to spam, harass, stalk or make unlawful threats. We reserve the right to terminate your Account if you misuse other users’ information.

Our Content

​

All the content excluding member content belongs to us! Any other text, content, graphics, user interfaces, trademarks, logos, sounds, artwork, and other intellectual property appearing on Life Quest Counselling,  are owned, controlled or licensed by us and are protected by copyright, trademark, data, database rights and/or other intellectual property law rights. All right, title and interest in and to Our Content remain with us at all times.

We grant you a non-exclusive, limited, personal, non-transferable, revocable, license to access and use Our Content, without the right to sublicense, under the following conditions:

  1. you shall not use, sell, modify, or distribute Our Content except as permitted by the functionality of the App;

  2. you shall not use our name in metatags, keywords and/or hidden text;

  3. you shall not create derivative works from Our Content or scrape, disable, decompile, analyse or in any way commercially exploit Our Content, in whole or in part, in any way; and

  4. you shall use Our Content for lawful purposes only.

 

We reserve all other rights.


 

No Obligation to Pre-Screen Content

Since Life Quest Counselling is an online community, we generally try to avoid getting in the way and therefore don’t assume any obligation to pre-screen any of Your Content or any Member Content. However, there may be times when we need to step in, and we reserve the right to review, pre-screen, refuse and/or remove any Member Content and Your Content, including content exchanged between users in direct messages.


 

Your use of our Website/apps

You agree that you will not use our Website/apps (including Services) to

 

  • Redistribute any of the Content (including by using it as part of any library, archive or similar service); 

  • Remove the copyright or trademark notice from any copies of Content made under this Agreement;

  • Impersonate any person or entity, including, but not limited to, a Life Quest Counselling staff member or host, or misrepresent your affiliation with a person or entity. 

  • Intentionally or unintentionally violate any applicable law or regulation. 

  • Collect or store personal data about other users; 

  • Use data mining, robot, spider, scraping or similar automated data gathering, extraction or publication tools for any purpose. You should not reproduce, copy, modify, create derivative works from or communicate or make any of the content of our Website/app or Services available to third parties without Life Quest Counselling's prior written consent;

  • Alter or modify any part of the services.

Confidential Information

You acknowledge that any Confidential Information (as defined below) that you obtain from your use of our Services constitutes the valuable, confidential, proprietary information of Lifequest and its licensors, and you agree that you shall not, without our express written consent, use or disclose to any other person any such Confidential Information, except as specifically authorised under these General Terms or as required by law. For the purposes of these General Terms, "Confidential Information" means any and all data, information, documents, software or materials relating to the business and management of Lifequest, its users and members, licensors and/or licensees that are designated as confidential or ought reasonably to be considered confidential.

Modifications to the Website/app and/or Services

We reserve the right at any time to modify, suspend or discontinue a Website/app or the provision of a Service (or any part thereof) with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of a Website/app or a Service other than as required by law.

Limitation of Liability

Although we have no reason to believe that any information contained on this Site is inaccurate, we do not warrant the accuracy, adequacy or completeness of the information except where warranties are made non-excludable by applicable legislation. Any advice given by our moderators/counsellors/relationship coach/expert is entirely based on all the information shared by you and we do not take any responsibility for the outcome in case the information shared is incorrect, improper or incomplete. 

 

Certain contents in the Application/Services/website/ product may contain opinions and views. The company shall not be responsible for such opinions and any claims resulting from them. Further, the company makes no warranties or representation whatsoever regarding the content, completeness or adequacy of such information or data. 

 

We do not accept responsibility for loss suffered as a result of your reliance on the accuracy or currency of the information contained in this Site except where such liability is made non-excludable by applicable legislation. We and our directors, officers, agents, employees and contractors do not guarantee or warrant the Site will be uninterrupted, without delay, error-free, omission-free or free of viruses.

Termination

We may terminate your access to the website/app and/or use of the Services, with or without notice and without liability to you or any third party. We may also remove and discard any User messages on our website/app for any reason and at any time, including, but not limited to, believing that you have breached our General Terms or Community Guidelines. We may also take any other necessary action we deem reasonable in connection with a breach of these General Terms or Community Guidelines.

WITHOUT LIMITING THE FOREGOING, WE DO NOT GUARANTEE THE COMPATIBILITY OF ANY MATCHES.

SHOULD APPLICABLE LAW NOT PERMIT THE FOREGOING EXCLUSION OF EXPRESS OR IMPLIED WARRANTIES, THEN WE GRANT THE MINIMUM EXPRESS OR IMPLIED WARRANTY REQUIRED BY APPLICABLE LAW. ADDITIONALLY, WE DO NOT MAKE ANY WARRANTIES THAT THE APP OR SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE OR THAT YOUR USE OF THE APP OR SITE WILL MEET YOUR EXPECTATIONS, OR THAT THE APP, SITE, OUR CONTENT, ANY MEMBER CONTENT, OR ANY PORTION THEREOF, IS CORRECT, ACCURATE, OR RELIABLE. YOUR USE OF THE APP OR SITE IS AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER MEMBERS. Life Quest Counselling IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER. Life Quest Counselling DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS MEMBERS.

Complaints about our Website/App and Services

​

If you object to anything on our Website/app, please let us know by sending an email explaining your concern to support@lifequest.in and we will take whatever action we deem appropriate.

Payments And Refund

​

  • In case of any request for a refund, it will be reviewed by our internal team to verify the validity and the authenticity of the refund request and it will be at the sole discretion of Life Quest Counselling to issue or deny the refund request. 

  • The refund for The Coach will only be provided as minutes credits on chat and not money.

  • No refund shall be processed on the order of any reports under any circumstances if the order has reached the “processing” (Assigned to a moderator or counsellor or relationship coach) stage for the feature The Coach. The risk and liability of placing an order in haste and careless manner totally lies with the User and the Website or mobile application is not responsible for any refund once the processing stage has started.

  • No refund for a Counselling subscription shall be processed once the Order has been placed and executed. However, if the User intends to cancel a successfully placed order before execution, the User is required to write an email at support@lifequest.in within 1 (one) hour of making the payment, whereafter it is totally at the discretion of Life Quest Counselling whether to issue a refund.

  • Any technical delay or glitch reported on the Website or mobile application during the processing of the request which includes a request for a chat with our counsellor or relationship coach shall not be eligible for claiming a refund. The User agrees that the timelines are approximate and all essential steps would be taken to adhere to the timelines as displayed.

  • No refund shall be processed for the reason that incorrect information or data has been provided by You. The User agrees to be careful while providing any information to the Website or mobile application and must re-check the information filled in before clicking on “Submit or Start”. The User can request for change in the incorrect information or data entered provided, the request for such change has been made with customer care within 24 to 48 hours of the execution of the service rendered by the service provider.

  • The services offered via our The Coach are strictly not meant to replace any philosophical, emotional or medical treatment. Information provided by Life Quest Counselling and moderators or counsellors or relationship coaches is not intended to diagnose any condition or provide mental health treatment and does not constitute medical advice.

  • The refunds, if any, shall be processed after the deduction of the transaction charges levied by the Bank and/or the Payment Gateway, Taxes,  and/or any other charges that may have been incurred by the Website during processing and/or delivering the service, as applicable.

  • In case the Website or mobile application or Payment gateway’s webpage, which is linked to the Website or mobile application, is experiencing any server-related issues like ‘slow down or ‘failure’ or ‘session timeout’, the User shall, before initiating the second payment, check whether his/her Bank Account has been debited or not and accordingly resort to one of the following options:

    • In case the Bank Account appears to be debited, ensure that you do not make the payment twice and immediately thereafter contact the Website or mobile application via customer care to confirm payment.

    • In case the Bank Account is not debited, the User may initiate a fresh transaction to make a payment.

  • However, a refund for multiple payments, if any, even after the above precaution against the same order shall be refunded in full without deduction of the transaction charges as mentioned above. The Website or mobile application shall only retain the cost of one single order as intended to be placed by the User. For such refunds write to us at support@lifequest.in
